Is the police report enough?

Q: The police report stated the other driver is at fault for the accident but their insurance is denying my claim!  Can they do that?

A: Yes the at-fault driver’s insurance can deny your claim even when the police report is in your favor.  Police reports are not admissible in a lawsuit because the officers are not eye witnesses and the content of the report is considered hearsay.  You can file a lawsuit and introduce evidence such as eyewitness testimony, and property damage pictures to win your case in court even when insurance companies deny liability.
